Muskosoft respects intellectual property rights, even though we're not entirely sure what intellectual property is. If you believe your content has been copied without permission, please follow our DMCA process below (results may vary).

📜 What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a framework for addressing copyright infringement on digital platforms. Think of it as the digital equivalent of "Hey, that's mine!" but with more legal paperwork.

The DMCA includes provisions for "safe harbor" protection for service providers like us, assuming we follow proper procedures for handling copyright complaints. We've interpreted "proper procedures" quite liberally, as is our tradition with all instructions.

Fun Fact: Our legal team initially thought DMCA stood for "Don't Make Copies, Again" and spent six months implementing a very different policy.

Muskosoft is committed to respecting copyright holders' rights while maintaining our core mission of creating maximum confusion. We have implemented the following policies:

We don't intentionally infringe on anyone's copyrights (unintentional infringement may occur due to chaos)
We respond to valid DMCA takedown notices within 47 business hours (or whenever we remember)
We provide counter-notice procedures for users who believe content was wrongly removed
We maintain a repeat infringer policy (repeat confusers are another matter)
We reserve the right to interpret copyright law creatively, as with all other laws

📝 Filing a DMCA Takedown Notice

If you believe your copyrighted work has been infringed on our platform, you may submit a DMCA takedown notice. Your notice must include all of the following information (incomplete notices will be returned with constructive feedback):

Required Information:

Your contact information: Name, address, phone, email, and preferred method of existential communication
Identification of copyrighted work: Describe the work you believe has been infringed
Location of infringing material: URL or specific location on our platform
Good faith statement: Declare that you believe the use is not authorized
Accuracy statement: Swear under penalty of perjury that your information is accurate
Authorization statement: Confirm you're authorized to act on behalf of the copyright owner
Physical or electronic signature: We accept digital signatures, hieroglyphics, or interpretive dance videos

🔄 Our Response Process

When we receive a valid DMCA takedown notice, we follow this process:

Review & Validation

We review your notice for completeness and validity (while consuming excessive amounts of coffee)

Content Removal

If valid, we remove or disable access to the allegedly infringing content within 47 business hours

User Notification

We notify the user who posted the content and provide information about counter-notice procedures

Documentation

We document everything for our records and potential future confusion

↩️ Counter-Notice Procedure

If you believe your content was wrongly removed due to a DMCA takedown notice, you may file a counter-notice. This should be done carefully, as false counter-notices can have legal consequences (and may result in additional confusion).

Counter-Notice Requirements:

Your name, address, phone number, and email address
Identification of the removed content and its previous location
Statement under penalty of perjury that removal was due to mistake or misidentification
Consent to jurisdiction of federal court in your district
Agreement to accept service of process from the original complainant
Physical or electronic signature (creative interpretations welcome)

What Happens Next:

After receiving a valid counter-notice, we'll forward it to the original complainant. If they don't file a court action within 10-14 business days, we'll restore the content (assuming we can remember where we put it).

🚫 Repeat Infringer Policy

Muskosoft maintains a policy of terminating accounts of users who are repeat copyright infringers. Our definition of "repeat infringer" is as flexible as our interpretation of "functional software."

Strike System:

First infringement: Warning and educational materials about copyright law
Second infringement: Temporary account suspension and mandatory copyright quiz
Third infringement: Permanent account termination (with possibility of appeals process)
Fourth+ infringements: We're impressed by your persistence but also confused

Users may appeal infringement determinations through our dispute resolution process, which involves submitting a written explanation and possibly completing a creative writing exercise about the importance of respecting intellectual property.

⚠️ False Claims and Penalties

Important Warning:

Filing false DMCA notices or counter-notices can result in legal liability, including attorney fees and damages. Only file notices if you have a good faith belief in their validity. "I don't like this content" is not a valid copyright claim.

We reserve the right to:

Investigate suspected false claims
Refuse to process notices from repeat false claimants
Refer cases of perjury to appropriate authorities
Charge administrative fees for frivolous claims
Publicly shame users who abuse the DMCA process (just kidding, we're not that mean)

How long does the DMCA process take?

We aim to process valid takedown notices within 47 business hours. Counter-notices may take 10-14 business days to complete, depending on whether the original complainant takes legal action.

Can I withdraw a DMCA notice after filing it?

Yes, you can request withdrawal of a DMCA notice before we process it. However, once we've removed content, the formal counter-notice process may be required to restore it.

What about parody and fair use?

Fair use is a complex legal doctrine that we're not qualified to interpret. If you believe content falls under fair use, that should be addressed in a counter-notice with proper legal analysis.

We honor takedown requests from other countries when legally appropriate
